The Council of the European Union in its Transport Telecommunications and Energy configuration meeting on 17 and 18 December 2009 made significant progress towards resolving the outstanding issues regarding the proposed directive on the deployment of Intelligent Transport Systems.

The proposed directive was adopted by the Commission in December 2008 alongside the ITS Action Plan considerably amended by the European Parliament in April 2009 and further amended following informal talks between Parliament and the Council with a view to an early agreement. The text as it stands is in substance acceptable for the member states. On the eve of the Council meeting the European Parliament also signalled its readiness to accept the substance of the text. The Council has now invited the competent bodies to finalise the agreement with  Parliament so that the directive can swiftly be adopted by both institutions once the Council has adopted its first-reading position at a forthcoming meeting.

The main sticking point is now a technical issue regarding the provisions on “delegated” acts introduced by Article 209 of the Lisbon Treaty.
